Access to the Services

Subject to the terms and conditions of this Agreement, CHROMA may offer to provide certain services, as described more fully on the Site / Application, and which are selected by User through the process provided on the Site / Application (“Services”), solely for User’s own use, and not for the use or benefit of any third party. CHROMA may change, suspend or discontinue the Services at any time, including the availability of any feature, or content. CHROMA may also impose limits on certain features and services or restrict User’s access to parts or all the Services without notice or liability. CHROMA reserves the right, at its discretion, to modify this User Agreement at any time by posting a notice on the Site, or by sending User a notice via email or postal mail. User shall be responsible for reviewing and becoming familiar with any such modifications. Use of the Services by User following such notification constitutes User’s acceptance of the terms and conditions of this User Agreement as modified. User certifies to CHROMA that if User is an individual (i.e., not a corporation) User is at least 18 years of age. User also certifies that it is legally permitted to use the Services and access the Site, and takes full responsibility for the selection and use of the Services and access of the Site / Application. This Agreement is void where prohibited by law, and the right to access the Site is revoked in such jurisdictions. User shall be responsible for obtaining and maintaining any equipment or ancillary services needed to connect to, access the Site or otherwise use the Services, including, without limitation, modems, hardware, software, and long distance or local telephone service. User shall be responsible for ensuring that such equipment or ancillary services are compatible with the Services.
While we exert reasonable efforts to ensure correct and up-to-date information on this website, CHROMA makes no warranties or representations as to its accuracy. CHROMA assumes no liability or responsibility for any typographical or other errors or omissions in the content on this site.

CHROMA endeavors to provide uninterrupted service through this website, however CHROMA does not represent or warrant that access to the Web site will be uninterrupted or that there will be no failures, errors or omissions or loss of transmitted information, or that no viruses will be transmitted on this Web site. CHROMA makes no representations about the suitability of the information and services contained on this Web site / application for any purpose. All such information and services are provided “as is” basis without warranty of any kind.

You are advised to read all ‘Notes’ and ‘Rules’, and shall be held responsible for the contents displayed on each web page while booking on our website or application.

Completion of the booking process shall deemed to be the acceptance of “Notes” and “Rules” on your behalf.

1. FEATURES OF EVENT REGISTRATION THROUGH APPLICATION

CHROMA Application online booking system is currently available only for ANNUAL CHROMA EVENT – HR IMAGERY 2017 and Future events will notified as and when needed.

You can book online for up to Five (5) Guests (Only adults) per booking.

Online bookings for HR IMAGERY 2017 can be made up to 2 days before the actual date of the event. Once purchased through Application the system will generate an Electronic Ticket and a printable itinerary receipt will be displayed. The electronic ticket will also be e-mailed to the e-mail address provided by you at the time of booking. To enter the event location and for check-in, you must present the itinerary receipt along with any of the following valid photo identifications: Photo Pan Card, Election card, Photo Driving License, and any Central/State government issued photo ID card.
CHROMA reserves the right to deny Entry if the conditions are not met.

2. PAYMENTS

Payment for event registration can be made through credit cards, debit cards, internet banking (direct debit) as specified below through PAYTM gateway.

Below is payment processing options when using CHROMA Application:

PayTM Service (collecting registration fees using PayTM)
When transacting through PayTM gateway, it is necessary that CHROMA users and ticket buyers transact through PayTM, and be subject to the applicable PayTM Terms of Use. CHROMA is not affiliated with PayTM, and neither is the agent or employee of the other, and neither is responsible in any way for the actions or performance (or lack thereof) of the other. The same is true with respect to CHROMA on the one hand and CHROMA Users and their users on the other hand. To the extent that the SERVICE is rendered in conjunction with any other provider of services, the same shall also be true, namely that to the extent that a user of the SERVICE hereunder does so in conjunction with the services of another service provider, such user will be subject to the other service provider’s terms of service, and neither CHROMA or the other service provider will be considered the agent or employee of the other, and neither will be responsible in any way for the actions or performance (or lack thereof) of the other. The terms of this T&C shall not in any way supersede the terms of any other service provider, nor shall the terms of service of any other service provider supersede the terms of this T&C with respect to the SERVICE.

When payments for tickets are to be made in INR currency, it is necessary that CHROMA and Ticket Buyers transact through the payment gateway and be subject to the applicable payment gateway Terms of Use. We do not store any credit card or banking information.

3. MODIFICATIONS, CANCELLATIONS AND REFUNDS:

Please note that if a booking is made it cannot be further modified or cancelled online / aplication.

In the rare event that we have to cancel the HR IMAGERY 2017, tickets can be used for the reschedule Date of the event. Reschedule date will be intimated only in the website or application.

If you are unable to access the Online registration due to an error

For any online booking clarifications /queries/ receipt generation

NO Refund against tickets purchased online.

4. RESPONSIBILITY

You represent that you are of sufficient legal age to use this service, and you possess the legal right and ability to create binding obligations for any liability you may incur as a result of the use of this service. You understand that you are financially responsible for all uses of this service by you and those using your login information. You warrant that all information supplied by you in using the booking facility is true and accurate. User in his /her own interest is requested to confirm this information from CHROMA in case of any doubts.

5. SECURITY

CHROMA will take appropriate steps with the help of implemented technology and security features, to protect the personal information you share with us . CHROMA will take all reasonable measures to ensure that information you transmit to CHROMA using CHROMA application On-Line booking engine will remain confidential and protected from unauthorized access but CHROMA does not warrant against unauthorized access and will not be liable for any unauthorized access by any means to that information.

6. MODIFICATION OF TERMS

CHROMA reserves the right to change these terms and conditions at any time without notice or liability. You are responsible for regularly reviewing these Terms and Conditions. Continued use of CHROMA Application / online booking, following any such changes shall constitute your acceptance of such changes.

7. PRIVACY STATEMENT:

7.1. Information collection and use

CHROMA shall not sell, trade or disclose to any third party other than an entity in the “CHROMA Group and CHROMA’s Sponsors / Partners” any information derived from the registration for, or use of, any on-line service without the consent of the user (except as required by law or in the case of imminent physical harm to the user or others). When CHROMA uses other agents, contractors or corporations to perform services on its behalf or as part of a joint promotion, CHROMA shall ensure that this entity protects the user’s personal information in a manner which is consistent with this statement.

7.2 Notification of changes

If we decide to change our privacy policy, we shall post such changes on our web site so that our users are always aware of what information we collect, how we use it, and under which circumstances, if any, we disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we shall notify users by way of an email. Users shall have a choice as to whether or not we use their information in this different manner. We shall use information in accordance with the privacy policy under which the information was collected.

Limitation of Liability and Disclaimer

IN NO EVENT SHALL CHROMA BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES RESULTING FROM
(a) The use or the inability to use the services;
(b) The cost of procurement of substitute goods and services or resulting from any goods, information or services purchased or obtained or messages received or transactions entered into through the services;
(c) unauthorized access to or alteration of the user’s transmissions or data;
(d) any other matter relating to the services; including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the website / Application. Neither shall CHROMA be responsible for the delay or inability to use the website /application or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the website / application, or otherwise arising out of the use of the website /application, whether based on contract, tort, negligence, strict liability or otherwise.

further, CHROMA shall not be held responsible for non-availability of the website /Application during periodic maintenance operations or any unplanned suspension of access to the website /application that may occur due to technical reasons or for any reason beyond CHROMA’s control. the user understands and agrees that any material and/or data downloaded or otherwise obtained through the website is done entirely at their own discretion and risk and they will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data. These limitations, disclaimer of warranties and exclusions apply without regard to whether the damages arise from
(a) breach of contract,
(b) breach of warranty,
(c) negligence, or
(d) any other cause of action, to the extent such exclusion and limitations are not prohibited by applicable law. The maximum liability on part of CHROMA arising under any circumstances, in respect of any services offered on the site, shall be limited to the refund of total amount received from the customer for availing the services less any cancellation, refund or others charges, as may be applicable. in no case the liability shall include any consequential loss, damage or additional expense whatsoever.

Property Rights

CHROMA may provide the User with content such as sound, photographs, graphics, video or other material contained in sponsor advertisements or information. This material may be protected by copyrights, trademarks or other intellectual property rights and laws. The User may use this material only as expressly authorized by CHROMA and shall not copy, transmit or create derivative works of such material without express authorization from CHROMA.
The User acknowledges and agrees that they shall not upload, post, reproduce or distribute any content on or through the Website that is protected by copyright or other proprietary right of a third party, without obtaining the permission of the owner of such right. Any copyrighted or other proprietary content distributed on or through the Website with the consent of the owner must contain the appropriate copyright or other proprietary rights notice. The unauthorized submission or distribution of copyrighted or other proprietary content is illegal and could subject the User to personal liability or criminal prosecution.
